(BILLINGS) Nickolas Garcia of Laurel, who admitted he raped a girl for two years starting when the victim was 6 years old, was recently sentenced to prison.
Garcia, 26 years old, was sentenced earlier this month in Yellowstone County District Court to 40 years at the Montana State Prison, with 30 of the years suspended.
The sentence was ordered by Judge Gregory Todd, who sentenced Garcia on one count of sexual intercourse without consent.
The case qualified for Jessica’s Law, which requires a minimum 100-year prison sentence for a sexual offender with a victim under the age of 12.
But prosecutors withdrew the Jessica’s Law penalty as part of the plea agreement.
Garcia allegedly forced an 8-year-old girl to perform oral sex on him for at least two years, beginning when she was 6.
Court documents state that the victim's aunt knew about the abuse but told the girl to keep it secret.
Prosecutors said in their sentencing memorandum that Garcia said he raped the girl due to a lack of intimacy with his wife.
The girl disclosed the abuse to her therapist.
As part of his sentence, Garcia must also complete sex offender treatment.
