BILLINGS -

For the second time in four months, Robert Calvin of Billings, accused of raping a child decades ago, will once again take his case to trial.

Jury selection gets underway on Monday in Yellowstone County District Court.

The judge declared a mistrial in March after just one day of testimony.

No reason was provided for nullifying the first trial.

Calvin is charged with two counts of sexual intercourse without consent, and one count of sexual assault.

Calvin's 40-year-old brother, William, was sentenced to a community treatment program in 2016 after pleading guilty to similar charges against the same victims.

The alleged abuse occurred in 1997 when the victim was just 13.

That victim is expected to testify early on in the case.

Other victims have since come forward, but the charges in this case stem from a single victim.

Prosecutors expect to rest their case on Wednesday.
